Boddy: Confidentiality Policy

The owner of Boddy.com (the “Site”) is Boddy, Inc. (“Boddy.com”, "us" or "we"). In this policy we outline each of the actions we perform for your privacy protection and how we operate with the information that you give to us through this Site.

How we protect your information

In order to protect your personal information SSL-encryption technology is used while transferring or receiving user information on the Site. We keep in a secure place the servers personally identifiable information is stored on. In spite of that, data communication over any wireless network can never be 100% secure. Therefore, although we do our best to keep your profile information safe, you have to consent that some online security and privacy limitations will inevitably be outside of our control. Boddy cannot guarantee that all information you exchange with or through our Site is 100% safe, inviolable and private. Any such data might be browsed or breached by a third party during transit. We do not make any guarantees, express or implicit, that we will eliminate any illegal access to your personal details.

INFORMATION WE COLLECT: We gather two kinds of information with the purpose of providing you with our services, first of them being  Personally Identifiable Information and second - Non-Personally Identifiable Information.

Personally identifiable information

That kind of data gives us specific details about who you are. While you work with the Site, you may have to fill out and submit some kind of online form, for example when you register for a membership, order or use our product or send feedback. In that case you have to give us some details about yourself. Engaging in activities of that kind is completely optional, but if you choose to engage in them, you may be asked to give us certain personal details (first name, last name, e-mail address, corresponding address, zip code, your employer, name of the department and job title, telephone number, information about your belongings and liabilities, etc.) When you order some of our products and services on this Site, we may ask you to give us the number of your credit or debit card. In certain cases (that depends on the product you wish to order) you might not be able to get the services you need without providing us with that information. You have to realize that when you click the “continue” button on a page containing a form you fill out, the details you have entered will be automatically transferred to us, and that includes situations when the process on subsequent pages has not been completed by you. Signing on into any of our services is possible only if you agree to the Terms of Use of membership and consent to provide us with personally identifiable information as mentioned before.

Non-personally identifiable information

That kind of data does not on its own identify a particular person. We collect in various ways some details about you assumed from where you go to the Site. These details are put together and researched on a personal and cumulative basis. This data might include, for example, the Site's Uniform Resource Locator ("URL") that you left just before entering our Site, or which URL you go to after that, or which browser you utilize, and also your Internet Protocol ("IP") address. Uniform Resource Locator is an address assigned to documents on the World Wide Web. An IP address is a computer's or device’s identifier on a Transmission Control Protocol/Internet Protocol ("TCP/IP") network, like the World Wide Web. Such Networks as the Web use the TCP/IP protocol in order to route information by using the IP address of the destination. Otherwise speaking, an IP address presents as a number that is assigned to your computer by default any time you are surfing the web, which allows web servers to establish the location of your computer and identify it. Computers need IP addresses so that the  users have an opportunity to communicate on the Internet.

How do we use the information we collect

We will use Personally Identifiable Information to enhance the operation of the Site, fill orders, improve our marketing and promotional efforts, statistically analyze site use, improve our product and service offerings, and customize the Site's content, layout, and services. We may use Personally Identifiable Information to deliver information to you and to contact you regarding administrative notices. We may also use Personally Identifiable Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms of Use, and this Privacy Policy. Your information may also be used by us or by third parties to whom we transfer it to provide the products or services you have requested.

When you use the Site we will store cookies on your computer in order to facilitate and customize your use of the Site. We may use an outside ad serving company to display banner advertisements on the Site. As part of their service, they will place a separate cookie on your computer. We will not provide any such third-party ad server with your Personally Identifiable Information. In addition, other advertisers may also place banner ads on the Site, and we will not disclose any Personally Identifiable Information to them.

We and our third party ad server may collect and use Non-Personally Identifiable Information about you, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server and whether you responded to a particular ad. In the event that your browser request that we do not track you or store a cookie, the Site is unable to honor such requests.

With whom do we share your information

Other than your credit or debit card information, we may share your Personally Identifiable Information with third parties in accordance with the terms of this Privacy Policy and applicable state and federal law. We provide the products and services offered on the Site through contractual arrangements with affiliates, service providers, and other third parties. We and such third parties use your Personally Identifiable Information to operate the Site and to deliver their products and services.

For example, we must release your credit card or debit card information to the card-issuing bank to confirm payment for products and services purchased on the Site; release your Personally Identifiable Information to the third party that will provide the products or services that you ordered; and provide order information to third parties that help us provide customer service. We will encourage our service providers to adopt and post privacy policies. However, the use of your Personally Identifiable Information by our service providers is governed by the privacy policies of those service providers, and is not subject to our control.

We may also provide Non-Personally Identifiable Information about our customers' sales, traffic patterns, and related information to third party advertisers, but these statistics do not include any Personally Identifiable Information.

Occasionally we may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. We will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

From time to time we or our marketing partners will send you email newsletters and updates announcing special offers and/or new features as well as materials that are promotional in nature. These email updates may also include offers from our marketing partners that you may be interested in. As part of our service you will receive these updates. If you want to update your email address or stop receiving any of the updates, follow the unsubscribe procedures at the bottom of any newsletter or update we send you. We reserve the right to rent, sell and share your Personally Identifiable Information with our third-party partners. Our third-party partners may send you advertisements and special offers that may be of interest to you.

Privacy policy of third parties

When you sign-up for services through the Site, keep in mind you will be interacting with a third party that operates under its own privacy and security policies. Except as otherwise discussed in this Privacy Policy, this document only addresses our use and disclosure of information we collect from you. Other sites accessible through the Site, and companies to whom your information is transferred, have their own privacy policies and data collection, use and disclosure practices. Please consult each site's privacy policy. We are not responsible for the policies or practices of third parties. Additionally, other companies that place advertising on the Site may collect information about you when you view or click on their advertising through the use of cookies. We cannot control this collection of information. You should contact these advertisers directly if you have any questions about their use of the information that they collect. You should also be aware that unsubscribing from us will not automatically unsubscribe you from third parties’ lists and/or databases.

Opting out of email communications

If you no longer wish to receive our emails, newsletter or promotional offers, you may "opt-out" of receiving these communications by opting-out on our unsubscribe page or by clicking here to unsubscribe. Please note that opting not to receive email does not exempt you from receiving administrative emails, which include but are not limited to, notices about membership status changes and alterations to our Terms of Use.

Changes to our policy

We may find it necessary or be legally obligated to update this Privacy Policy from time to time, so please review it frequently. When we do, we will post those changes on this page and update the effective date so that you are always aware of the information we collect, how we use it, and under what circumstances we disclose it.

You acknowledge that this Privacy Policy is part of the Site Terms of Use, and by accessing or using the Site, you agree to be bound by all of its terms and conditions.
